East Down Yacht Club's rights and obligations

  1. The access lane, from the main Killyleagh to Comber road as far as the bridge over the small stream, is jointly owned by the properties on either side of the lane. East Down Yacht Club has full Right of Way over the lane.
  2. From the bridge to the cattle grid - the lane is owned by Mr Nelson. Again, the Club has a Right of Way to enjoy a free an uninterrupted right of passage over the lane.
    (The Club owns the gate at the bottom of the hill and, as a concession, allows the farmer to close the gate at times when the club is not being used by many members.)
  3. From the cattle grid -now the gate key pad - the Club owns all of the land within its perimeter fence and as far as the high tide line. In effect, we lease the foreshore where it is crossed by our walkway to the pontoon and by our slipway.
  4. Mr Nelson has a Right of Way from the cattle grid, around the seaward side of the hedge that splits our site, past the flag pole, across the head of our slipway and into the fields that he owns to the North of our site. This Right of Way is specifically to Mr Nelson and is specifically to allow him to service the fields to the North.
  5. No other Rights of Way are recorded at Land Registry.
  6. The Club has not granted any Right of Way to any other party or organisation.
  7. A Right of Way is exactly that. It is not a car park and should not be obstructed by any party. (Cars parked at the head of our slipway aren't just at risk from passing boats and their booms; they are also obstructing a Right of Way.)


There are courtesies associated with the use of Rights of Way. These include driving with due consideration and not causing unacceptable obstructions. East Down Yacht Club has the right to free and uninterrupted passage from the county road to the yacht club site. Mr Nelson also has the right to free passage for both himself and his livestock along the stipulated Right of Way across the EDYC site. EDYC is entitled to have a gate at its perimeter to prevent animals straying onto the site. Mr Nelson does not have the right to grant use of his Right of Way to any third parties.
